New Contract Changes Are Coming July 1

Texas real estate forms are getting a significant update in 2026, with changes affecting contracts, disclosures, listing agreements, broker compensation language, notices, and more. Many revised forms may be used voluntarily once available, while several mandatory forms take effect July 1, 2026.

The updates stem from revisions by both the Texas Real Estate Commission (TREC) and Texas REALTORS® and are designed to align with evolving industry practices, improve clarity for consumers, and introduce new disclosure requirements.

Key Changes REALTORS® Should Know

Some of the biggest updates include:

  • Revisions to Paragraph 12 across several contracts related to broker compensation and expense contributions
  • New disclosure requirements involving insurance history, conservation easements, private roads, storage tanks, and water rights
  • Updates to notice delivery methods, including overnight courier options
  • Reorganized addenda and notices sections for improved clarity and consistency
  • Removal of broker-to-broker compensation language from several Texas REALTORS® forms and listing agreements
  • New forms related to water disclosures, property conditions, and listing agreement amendments

Several TREC contract revisions will become mandatory July 1, 2026, while revised Texas REALTORS® forms carry an effective date of June 15, 2026.
