Fact Check: New HOA Laws

Have you seen posts about new HOA laws on your Facebook timeline? It’s true that Texas REALTORS®️ helped advance legislation at the Texas Capitol last session that reformed HOAs to favor private property rights. However, these posts were mistaken about the date the law went into effect.

All but one of the provisions of that law went into effect in September 2021. (The other provision was effective December 1, 2021.) The law that passed through the Texas Legislature in 2021 had numerous provisions including expansion of homeowners’ ability to erect perimeter fences in HOAs; it prohibited HOAS from restricting the display of religious items on their property; and it increased transparency of decision making by HOA boards.

The law, authored by Sen. Brian Hughes (R-Mineola) and carried through the Texas House by Rep. Chris Turner (D-Grand Prairie), received bipartisan support. This is just one example of the influence of Texas REALTORS®️ at the Texas Capitol!
