Let’s Clarify the Clear Cooperation Policy

Since May of 2020, MetroTex has undertaken an education and warning campaign to ensure our MLS Participants and Subscribers are aware of the Clear Cooperation Policy. As of this date, more than 80 warnings have been issued related to this new policy.

As a reminder, the Clear Cooperation Policy reads as follows:

“Within one (1) business day of marketing a property to the public, the listing broker must submit the listing to the MLS for cooperation with other MLS participants. Public marketing includes, but is not limited to, flyers displayed in windows, yard signs, digital marketing on public facing websites, brokerage website displays (including IDX and VOW), digital communications marketing (email blasts), multi-brokerage listing sharing networks, and applications available to the general public.”

Effective January 1, 2021, there will be no warnings related to violations of this policy. Any MLS participant or subscriber found in violation of the policy will be fined based on the policy below:

1st Offense: $1,000 fine, payable within 30 days of Notice of Violation

2nd Offense: $2,500 fine, payable within 30 days of Notice of Violation

3rd Offense: $5,000 fine, payable within 30 days of Notice of Violation

4th Offense: A hearing before the MLS Committee will be scheduled. Sanctions may include fine up to $15,000 (maximum allowed by NAR), suspension of MLS services for no less than one (1) month but no more than one (1) year.
